As harmonization discussions are actively proceeding, what kind of grace period will there be? If someone reads a pre-filed disclosure (PFD) and has substantial commercial preparations for use before any filing, should they get prior user rights? Should there be any rights given to an innocent deriver? What if a third-party re-discloses the PFD, is that prejudicial? Should applicant be required to submit a declaration identifying the PFD in order for it to be graced?
