Trade secret protection has taken on increasing importance with the advent of the AIA and the first-to-invent regime. Recently, practitioners pursuing trade secret actions have had greater success at the ITC, in district court, and in various state courts. Some courts have even suggested that parties can both patent and protect certain inventions with trade secrets. Given their increased importance, this webinar will focus on the nuances of trade secret practice, the emerging Federal standard at the ITC, and the difficult choice some innovators make now between pursuing patent protection and protecting their products with secrecy.
