Divided infringement has long been a consideration in procuring and enforcing patents on methods of treatment and other Bio/Pharma inventions.  However, with Section 101 rejections often necessitating narrowing claim amendments, strategies for dealing with divided infringement have become even more critical in the context of personalized medicine.  In this Webinar, our panel will provide an overview of recent developments in the law, discuss various practical implications of the test for divided infringement as they relate to personalized medicine and other types of Bio/Pharma patents, and present possible strategies for drafting claims that are more easily enforced.
