Description
Original air date:  11/8/17. Parallel Universes: The Intersection of IPRs and District Court Litigations
The last several years have seen tremendous growth in Inter Partes Review (IPR) proceedings filed. Many courts
with parallel related litigation now routinely grant stays if and when the USPTO decides to accept the IPR petition and open the proceeding. But have the IPR proceedings really simplified the overall process and cost of litigation? What complexities have been created when not all issues are not resolved by the PTO proceeding? Practitioners and
judges are confronting more issues all the time. Should the litigation be stayed? What is the extent of any estoppel?
What is the potential impact to IPRs of the pending SAS Institute and Oil States Supreme Court cases? How should
the IPR proceedings shape any subsequent trial in the District Court, and are there any limitations on the evidence
that should be admitted? Join us and hear what our panel of experienced litigators and judges has to say about the
intersection of IPRs and parallel district court litigations.

Presented by:  Donald Banowit of Sterne, Kessler, Goldstein & Fox P.L.L.C.; R. Eric Hutz of Reed Smith, LLP; Chief Judge Joy Flowers Conti of United States District Court Western District of Pennsylvania; (moderated by) Patrick M. Arenz of Robins Kaplan LLP.
