Speakers will address recent post-Therasense Federal Circuit decisions relating to inequitable conduct both as a tool in patent litigation and as cautionary tales in patent prosecution. Speakers will provide an overview of recent decisions concerning inequitable conduct including the Federal Circuit's decisions in American Calcar v. American Honda, Apotex Inc. v. UCB, and Intellect Wireless, Inc. v. HTC affirming findings of inequitable conduct. Next, discussions regarding the impact of the decisions and how they relate to assertions of inequitable conduct in litigation.
