It has been over three years since the introduction of inter partes review and post-grant review, including covered business method review.  The PTAB has issued hundreds of
decisions.  Patterns are emerging and best practices are being defined.  Institution and trial are two separate proceedings that warrant individual attention and both need to be perfected.  Issues such as the patent owner preliminary response, amendments, discovery, depositions, objections to evidence, and hearings will be discussed.  Guidance will also be provided as to how to handle multiple proceedings at the PTAB and district court and when to take certain actions.
