The America Invents Act of 2011 ushered in a new era of patent law. Today, parallel administrative challenges to patentability are frequent, and something any qualified patent lawyer should be well-aware of. With thousands of ongoing challenges and dozens of new appellate decisions, a body of substantive and procedural law has emerged. We walk through some of the basic and more advanced aspects of Patent Trial and Appeal Board (PTAB) practice, suggesting best practices for those both new and seasoned before the PTAB. Presented by
Jonathan Stroud, Chief Patent Counsel, of Unified Patents;
David Cavanaugh, Partner, of Wilmer Hale; and
Scott Chambers, Principal, of Porzio, Bromberg & Newman; and moderated by
Christa Brown-Sanford of Baker Botts.
